These Terms of Use govern access to and use of eCapital Mentor. eCapital Mentor is operated from New South Wales, Australia.
1. Access. Access is granted to the named account holder only. Account credentials must not be shared. Access may be suspended or withdrawn where these terms are breached.
2. Purpose of the platform. eCapital Mentor is an educational and decision-support platform for business owners, entrepreneurs, investors, accountants and advisers. It presents educational material, records the information you supply, and produces documents from the information you have recorded.
3. Not professional advice, and no licence held. Nothing produced by the platform is professional advice. The operator does not hold an Australian financial services licence and does not hold an Australian credit licence. Nothing on the platform is financial product advice within the meaning of the Corporations Act 2001 (Cth), credit assistance within the meaning of the National Consumer Credit Protection Act 2009 (Cth), tax agent services within the meaning of the Tax Agent Services Act 2009 (Cth), legal advice, or a valuation. Obligations relating to law, tax, licensing, employment, privacy and consumer protection must be confirmed with the responsible authority or a qualified adviser before anything produced here is acted upon.
4. Your information. Figures, assumptions and statements recorded in the platform are yours and remain yours. The platform does not verify them and does not supply market evidence, valuations, tax rates or regulatory thresholds. You grant the operator only the permission needed to store your information, present it back to you, and produce your documents from it.
5. Your responsibilities. You are responsible for the accuracy of what you record, for the decisions you take, and for obtaining professional advice where it is required. You must not use the platform unlawfully, or to record information you have no right to record.
6. Your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). For a major failure you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value; and to compensation for any other reasonably foreseeable loss or damage. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that cannot lawfully be excluded.
7. Liability. Subject to clause 6, and to the extent the law allows, the operator is not liable for a business decision you take, for loss of profit or opportunity, or for loss arising from information you recorded incorrectly; and liability that can lawfully be limited is limited, at the operator's election, to resupplying the service or paying the cost of having it resupplied.
8. Availability and change. Registered capability may be added, changed or withdrawn. Where a change affects these terms, a new version is published and acceptance is requested again.
9. Records. Actions that change stored data are recorded in an append-only audit record.
10. Ending your access. You may stop using the platform at any time and may ask for your account records under the Privacy Policy. Records the operator must keep by law are retained for the periods stated in the Privacy Policy.
11. Governing law. These terms are governed by the law of New South Wales, Australia, and you and the operator submit to the non-exclusive jurisdiction of the courts of that State. This clause does not remove any right you have to bring a matter before a tribunal or regulator that has jurisdiction over it.
12. Acceptance. Acceptance of these terms is required before the platform is used.
